The Gorilla Crew Program Terms and Conditions

Gorilla Dirt LLC (“Gorilla DIrt” or “us”) is excited to offer our customers The Gorilla Crew program (the “Program”), which provides reward points and benefits to customers who shop on gorilladirt.com.

Please read these Program Terms and Conditions (“Program Terms”) carefully. By participating in the Program, you agree to be bound by these Program Terms. If you do not agree to these Program Terms, do not participate in the Program. Your continued use of the Program constitutes acceptance of these Terms.

These Program Terms supplement the Terms of Use (“Terms of Use”), which apply to the use of the Program. Any disputes arising from these Program Terms or the Program will be subject to the Gorilla Dirt Terms of Use, including the limitations of liability, governing law, and dispute resolution procedures specified in the Terms of Use (including the class action waiver and mandatory arbitration terms).

  1. Eligibility for Program Membership
    1. Legal residents of the United States who are 18 years of age may join the Program.
    2. Membership in the Program is free.
    3. The Program is offered for personal use only. Corporations, groups, associations, commercial customers, or individuals purchasing items for commercial use or resale are not eligible for membership in the Program.
    4. Program members may have only one account and the sharing of an account between individuals is prohibited.
    5. Current employees of Gorilla DIrt LLC or its affiliated companies may not participate in the Program.
  2. How to Enroll
    1. To enroll in the Program using your mobile or desktop device, you must enter all required information (i.e., full name and valid email) and indicate your agreement to these Program Terms, the Terms of Use, and acknowledge your consent to Gorilla Dirt’s Privacy Policy. Enrollment is only complete when you have provided your full name and email, either at enrollment or at checkout, and clicked the purchase button at checkout.
    1. At your option, at sign-up, you may enter the month and day of your birthday to receive an additional birthday offer.
    2. As a member, you are responsible for ensuring that your information is current and accurate and update such information as necessary in your account settings. It is also your responsibility to notify us immediately of any suspected unauthorized activity on your account.
  3. Program Tiers
    1. The Gorilla Crew Program has three tiers of membership: Adventure, Expedition, and Founding Partner.
    2. You select which tier you would like to join at the point of purchasing the membership. Once the membership is purchased you cannot upgrade automatically. Please contact us to make any changes.
    3. Purchases made prior to enrolling in the Program do not count toward your rolling 12-month/365-day spend.
    4. Expedition and Founding Partner memberships are automatically upgraded to 60-day return options. All terms still apply that items must be unused.
    1. Any upgrade in tiers as a result of contacting us will take effect 30 days after the order has fully shipped or 30 days after the eligible retail purchase. If you achieve a higher tier status based on eligible purchases during a rolling 12-month period, your tier status will be upgraded. If you return an item resulting in your total rolling 12-month spend dropping below tier eligibility, as applicable, you will not progress to the higher tier level or will be downgraded to a lower tier level immediately. If your eligible purchases qualify you for a new tier level and you do not return a product resulting in your 12-month spend dropping below tier eligibility, you will retain your new status for the following 12-month period.
  4. Tier Benefits
    1. All membership tiers enjoy a variety of benefits (such as Points, Rewards, special offers, sweepstakes, one-of-a-kind experiences, exclusive events, and advance access to products) made available by Gorilla DIrt at its sole discretion from time to time (“Benefits”). Benefits may vary by tier and some tiers may have more benefits than others. The timing, type, and availability of any Benefits will be determined by Gorilla Dirt at its sole discretion.
    2. Certain Benefits, such as access to purchase unreleased products may or may not be available to everyone due to limited stock availability. If Gorilla Dirt sells out of a certain product there is no guarantee that the product will be available again for purchase.
    3. Adventure members will receive 2 base Points for every $1 in eligible purchases, as described in 7(c), rounded up to the nearest $1 increment.
    4. Expedition members will receive 5 base points for every $1 in eligible purchases, as described in 7(c), rounded up or down to the nearest $1 increment.
    5. Founding Partner members will receive 8 base points for every $1 in eligible purchases, as described in 7(c), rounded up or down to the nearest $1 increment.
    6. All members are eligible to earn bonus Points on purchases of Gorilla Dirt or any other brand products found on gorilladirt.com unless specifically stated for that product.
    7. Gorilla Dirt may offer different tiers exclusive offers on products or services, invitations to private events, and other exclusive Benefits, announced periodically via email or on site.
  5. Birthday Offer
    1. Members that meet the eligibility criteria identified below will receive a 50-point gift at the time the birthday offer is sent. Birthday offer amounts are set in Gorilla Dirt’s sole discretion and are subject to certain product and brand exclusions that will be communicated when the birthday offer is delivered.
    2. To qualify for the annual birthday offer, you must have joined the Program and submitted the month and day of your birth on the Account profile section in your online account.
    3. Date of birth cannot be modified at a later date in order to qualify for this offer.
    4. Eligible members will receive their annual birthday points via automatically on their birthday.
    5. Members are limited to one birthday offer per calendar year.
    6. The email communicating the birthday offer may contain additional terms for redemption.
    7. You may withdraw from receiving the birthday offer by removing your birthday information from our account settings.
  6. Earning Points
    1. Under the Program, members may earn points on the purchase of products or services (“Points”), which will convert into Points as described below.
    2. To earn Points on eligible products or services online, you must either be signed into your account during checkout.
    3. Points earned from the purchase of products or services are calculated after all store credits or Expedition Perks rewards are applied, but before taxes, shipping, and other fees are added to the transaction.
    4. In addition, you may not earn Points on the purchase of gift cards, charitable contributions, or event tickets. You will also not earn Points on taxes, shipping, and other fees.
    5. Points have no fixed value, may not be redeemed for cash, and may not be pooled, transferred, gifted, or sold.
    6. Points are calculated based on your tier level at the time of purchase.
    7. During Limited Promotional Periods, you may earn bonus Points on certain discounted products, on select products or brands, or by participating in other community engagement activities (i.e., participating in a survey or attending a sponsored event). The Program will announce these Limited Promotional Periods, including the specific ways members may earn bonus Points on-site or by emailing eligible Gorilla Dirt members. Bonus Point offers during Limited Promotional Periods are subject to change without notice and at any time at the sole discretion of Gorilla Dirt.
    8. If your payment is declined, Points associated with that order will be removed from your account.
    9. You cannot earn Points on orders associated with a billing address outside of the United States.
    10. Each time you accumulate 500 active Points, those Points are automatically converted to a $5 reward (“Reward”). The 500 Points associated with that $5 Reward are immediately available to be used for payment at checkout.
    11. Points will expire 24 months after activation.
    12. Points are tracked on a first in/first out basis. For example, you accrue 400 Points from an order in October 2021 and an additional 300 Points from an order in December 2021. The 400 Points accrued in October along with 100 of the Points accrued in December would be converted into a $5 Reward, leaving the remaining 200 Points from the December 2021 order.
    13. If you return a product, any Points accrued from that purchase will be deducted permanently from your account upon acceptance of the product and issuance of a store credit or refund under Gorilla Dirt’s Return Policy.
    14. If the product is not accepted under our Return Policy, no change to Points or Rewards would occur.
  7. Using Rewards
    1. Rewards may be used toward the purchase of products or services online.
    2. There is no limit on the total value of Rewards you can redeem on any single transaction.
    3. You can choose to redeem some or all of your available Rewards during the checkout process by selecting the Reward amount you wish to redeem from the provided menu. The Program will debit the oldest $5 Reward(s) from your account first when redeeming rewards toward new purchases. Rewards are single-use.
    4. If you redeem Rewards at checkout, those Rewards will be applied to the order subtotal. Gift cards, charitable contributions, packaging, taxes, shipping, and any special order handling charges cannot be purchased or paid for with Rewards.
    5. Rewards are not redeemable for cash.
    6. Rewards may only be redeemed in increments of $5. If redeeming rewards in excess of the order subtotal, then any difference between the subtotal and the incremental $5 Reward figure will be forfeited.
    7. All returns must be made in accordance with Gorilla Dirt’s Return Policy. If you return a product purchased in whole or in part with a Reward, the reward value will not be refunded or credited to you. The refund or store credit amount you receive will be the amount paid after the Reward was applied.
  8. Customer Service Inquiries and Cancelation
    1. If you believe your Points or Rewards were not accurately posted to your Program membership page in your online account, or you have any other questions or complaints, customer support is available by emailing [email protected].
    2. You may ask a Team member about your current Points balance and Rewards, as well as update your Program profile by contacting us. The Team member will ask you to verify your account credentials.
    3. You may also update your Program profile and view membership status, Points and Rewards balances by logging into our website and navigating to your account settings.
    4. Membership in the Program is voluntary and you may withdraw at any time. If you cancel or withdraw, you permanently forfeit any Points and Rewards, as well as your membership, and start payment.
  9. Program Communications
    1. The Program will send transactional emails related to Program membership including but not limited to the following: welcome email, recurrent membership status statements and/or updates; and reminders about upcoming expiration of earned Points, Rewards, or other Benefits. To stop receiving these transactional communications, you must cancel your membership.
    2. By enrolling in the Program, you will also receive marketing communications from Gorilla Dirt and its affiliates to the email you provided upon account creation or updated in your account settings. To opt-out of receiving promotional emails, you can follow the instructions for unsubscribing in each email.
    3. You may unsubscribe or adjust your marketing preferences while still remaining in the Program.
  10. Program Restrictions and Termination
    1. The Program may not be used for re-selling or commercial use. Should Gorilla Dirt reasonably suspect that you are using the Program for reselling products or for commercial use, it will terminate your account immediately and without notice.
    2. Violation of these Program Terms may result in termination from the program.
    3. Rewards may not be gifted, transferred or sold.
    4. Any Rewards, Benefits or offers may not be applied retroactively to previous transactions.
    5. In cases of reasonably suspected fraud, misrepresentation, deception, forgery, or other abuses, Gorilla Dirt reserves the right to take appropriate administrative and/or legal action, including the termination of your participation in the Program.
    6. If an account is terminated for any reason, you will no longer be able to access account features and all existing Points, Benefits and Rewards will be forfeited.
    7. Gorilla Dirt reserves the right to deny or terminate membership for any reason, and at our discretion.
  11. Changes to the Program or Program Terms
    1. We may make changes to these Program Terms at any time in our sole discretion without prior notice.
    2. Gorilla Dirt may amend, cancel, suspend, terminate, or otherwise change the Program or any of its benefits and features, in whole or in part, at any time for any reason without prior notice. Changes may include, but are not limited to, the number of Points you can earn, the type of transactions that qualify for Points, the accrual rate of Points for qualifying transactions, and the redemption of Rewards or other Benefits, even though changes may affect the value of Points or Rewards.
    3. If we make material changes to these Program Terms or our Program, we will provide notice of such changes on the Gorilla Crew page on our sites, or by posting the amended Program Terms to our site and updating the “Last Updated” date above. Unless we say otherwise in our notice, the amended Terms will be effective immediately.
    4. Your continued access to and use of the Program will confirm your acceptance of the changes to the Program or these Program Terms. If you do not agree to the amended Terms, you must cancel your membership in the Program.
    5. All interpretations of these Program Terms are at Gorilla Dirt’s sole discretion, and Gorilla Dirt’s decisions will be final.
    6. In the event the Program is discontinued or combined with another program, Gorilla Dirt will attempt to notify you in advance within a reasonable timeframe through the email associated with your membership or by posting relevant information on the Gorilla Crew page on our sites. Any unused Points or other Benefits may not be carried into any new program. You will not be entitled to any compensation for any unused Points or Rewards, and any Points, Rewards, or Benefits may have a lesser or different value under any future program.
  12. Privacy and Notice of Financial Incentive
    1. Please read our Privacy Policy carefully to understand how Gorilla Dirt collects, uses, and discloses information about customers, including with respect to the Program, how to update and change your personal information, and how we communicate with you.
    2. The Program, including the birthday offer, may be considered Financial Incentives under the California Consumer Privacy Act (“CCPA”). These Program Terms explain the Benefits offered to you under the Program, how to enroll and how to withdraw from the Program, and that you may withdraw at any time. As described in these Program Terms, participation in the Program requires the provision of identifiers (name and email), and, if you choose to participate in the birthday offer, provision of a characteristic of protected classifications (birth day and month), and also involves the collection of commercial information (e.g., products purchased and Benefits used). The value of your personal information is reasonably related to the value of the Benefits provided to you in connection with the Program.
  13. Program Disclaimer
    1. Gorilla Dirt makes no warranty, express or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to the Program or any products or services related to the Program.
